Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Straycy, a lead attribution platform operated by Digital Media Estonia OÜ (“Company”, “we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms.

1. Definitions

• “Service” means the Straycy website (straycy.com), dashboard (app.straycy.com), WordPress plugin, and all related tools and APIs.
• “Customer” means the individual or entity that creates an account and subscribes to the Service.
• “End User” means a visitor to the Customer’s website whose data is processed through the Straycy plugin.
• “Content” means any data, text, or information submitted to or processed through the Service.

2. Account registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access.

3. Service description

Straycy is a WordPress-native lead attribution platform that tracks the source of form submissions on your website using UTM parameters, referrer data, and first-party cookies. The Service provides a dashboard for viewing lead attribution data and tools for syncing that data with third-party platforms.

4. Subscription and billing

4.1 Plans and pricing

The Service is offered in tiered subscription plans as described on our pricing page. Prices are in EUR and exclude applicable taxes (VAT). We reserve the right to change pricing with 30 days’ notice.

4.2 Free trial

New accounts receive a 14-day free trial with full access to the Service. No credit card is required for the trial. At the end of the trial, you must subscribe to a paid plan to continue using the Service.

4.3 Billing

Paid subscriptions are billed monthly or annually in advance via Stripe. You authorize us to charge your payment method on each billing cycle. Failed payments may result in suspension of your account.

4.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period.

4.5 Refunds

We offer refunds on a case-by-case basis within the first 14 days of a paid subscription. Contact hi@straycy.com for refund requests.

5. Your responsibilities

By using the Service, you agree to:

• Comply with all applicable laws, including GDPR and ePrivacy regulations
• Maintain a valid privacy policy on your website that discloses the use of Straycy and the data it collects
• Obtain appropriate consent from your website visitors where required by law before tracking them
• Use the Service only for lawful business purposes
• Not attempt to reverse-engineer, copy, or redistribute the Service
• Not use the Service to collect data from websites you do not own or have authority over
• Not exceed the usage limits of your subscription plan

6. Data ownership

6.1 Your data

You retain full ownership of all data collected through the Straycy plugin on your website. This includes visitor tracking data and lead data. We do not claim any ownership rights over your data.

6.2 Data processing

We process your data solely to provide the Service. We act as a data processor on your behalf for End User data. Our data processing practices are described in our Privacy Policy.

6.3 Data portability

You can export your data (leads and attribution records) at any time via CSV export from the dashboard. Upon account termination, your data remains accessible for 30 days, after which it is permanently deleted.

7. Intellectual property

The Service, including its code, design, documentation, trademarks, and content, is the intellectual property of Digital Media Estonia OÜ. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. This license does not include the right to modify, distribute, or create derivative works of the Service.

8. Availability and support

8.1 Uptime

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We are not liable for downtime caused by maintenance, third-party service outages, or circumstances beyond our control.

8.2 Support

Customer support is provided via email at hi@straycy.com. Response times vary by subscription tier. We do not guarantee specific resolution times.

9. Limitation of liability

To the maximum extent permitted by law:

• The Service is provided “as is” without warranties of any kind, express or implied.
• We do not warrant that the Service will be error-free, secure, or uninterrupted.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Digital Media Estonia OÜ from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable law.

11. Termination

11.1 By you

You may terminate your account at any time by cancelling your subscription and contacting us at hi@straycy.com.

11.2 By us

We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or use the Service in a manner that threatens the security or integrity of the platform. We will provide reasonable notice where possible.

11.3 Effect of termination

Upon termination, your access to the Service is revoked. Your data remains available for export for 30 days. After 30 days, all data is permanently deleted.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Estonia. Any disputes arising from these Terms or the Service shall be resolved in the courts of Tallinn, Estonia. Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
